Terms of service
These Terms of Service ("Terms") govern access to and use of PoolTechDesk, a software-as-a-service product for pool service companies, provided at pooltechdesk.com and app.pooltechdesk.com (the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the business you represent ("you" or "Customer").
1. The service
PoolTechDesk is a subscription tool for recurring route scheduling, chemical readings, service reports and mobile invoicing for pool service companies, offered on the Starter, Growth, and Pro plans described on our pricing page. Features included in each plan may be updated over time; we will not remove a feature you're actively relying on without reasonable notice.
2. Accounts and your responsibilities
You're responsible for the accuracy of the information in your account, for keeping your login credentials secure, and for all activity that happens under your account. You must be authorized to act on behalf of the business signing up. You're responsible for the accuracy of service agreements, invoices, and other business documents you create using the Service — PoolTechDesk provides the tool, not professional pricing, chemical-dosing, or legal advice.
3. Plans, billing, and the 14-day trial
New accounts get a free 14-day trial with no credit card required. If you choose to continue after the trial, you'll select a plan and enter payment details at that point. Subscriptions renew automatically each billing period (monthly or yearly, depending on what you select) until canceled. You can cancel at any time from your account settings; cancellation takes effect at the end of your current billing period.
4. The 12-month price lock
The plan rate you sign up at is guaranteed for at least 12 months from your signup date. If we change list prices during that period, your subscription keeps its existing rate until your 12-month lock expires, and we will notify you in advance of any change that will apply to your account once the lock period ends. Upgrading or downgrading your plan starts a new 12-month lock at the new plan's rate from the date of the change. Per-extra-user rates published on the pricing page are covered by the same lock as your base plan rate.
5. Acceptable use
You agree not to use the Service to violate any applicable law, to store or transmit unlawful, infringing, or harmful content, to attempt to gain unauthorized access to the Service or other accounts, to interfere with the Service's normal operation, or to reverse-engineer or resell the Service without our written permission. We may suspend or terminate accounts that violate this section.
6. Your data
Data you enter into PoolTechDesk — customer records, properties, bodies of water, service plans, chemical readings, and invoices — belongs to you, not to us. You can export your data at any time from your account, and we will provide a reasonable export of your data upon request within 30 days of account cancellation. 7. Chemical readings are a record, not advice
PoolTechDesk lets you log chemical readings (pH, free chlorine, alkalinity, CYA, salt, temperature) that your technicians measure in the field. The Service records what was measured; it does not calculate or recommend chemical dosing. Decisions about how much of any chemical to add are your responsibility and your technicians' professional judgment, not a recommendation from PoolTechDesk.
8. Payment processing through Paddle
All purchases made through the Service are processed by Paddle.com Market Ltd ("Paddle"), our authorized reseller and Merchant of Record. This means Paddle is the seller of record for your subscription, handles billing, tax, and payment processing on our behalf, and Paddle's own Buyer Terms and policies apply to the payment transaction in addition to these Terms. Refund requests are handled per our Refund Policy, through Paddle or by contacting us directly. Separately, PoolTechDesk itself does not process, hold, or transmit payments between you and your own customers — invoices you send through the Service are documents, not a payment gateway; see the billing & invoicing feature page for details.
9. Limitation of liability
The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, PoolTechDesk and its operator will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.
10. Termination
You may cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms and don't correct the breach after reasonable notice, or if required by law. Upon termination, your right to use the Service ends, though your right to export your data for 30 days as described in Section 6 survives termination.
11. Changes to these terms
We may update these Terms from time to time. For material changes, we'll provide reasonable advance notice by email or through the Service before the changes take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
